These Terms and Conditions set out the basis on which Waste Disposal Stockwell provides waste collection and related services to consumers and business customers in the United Kingdom. By booking a service, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order.
In these Terms and Conditions, the following expressions have the meanings set out below:
Customer means the person, company, partnership or other entity requesting the services from Waste Disposal Stockwell.
Services means any waste collection, removal, clearance, transportation, or related services provided by Waste Disposal Stockwell.
Waste means any materials, refuse, rubbish, junk, unwanted items or other substances presented by the Customer for collection, excluding any prohibited or hazardous waste not agreed in advance.
Agreement means the contract between the Customer and Waste Disposal Stockwell for the supply of Services in accordance with these Terms and Conditions and the booking confirmation.
Waste Disposal Stockwell provides waste collection and disposal services for domestic and commercial customers. Services may include one-off clearances, regular scheduled collections, bulky waste removal, and other related waste management tasks as agreed in writing.
The exact scope of the Services, including the collection location, type and estimated volume of Waste, date and time of collection, and any specific access requirements, will be confirmed during the booking process and set out in the booking confirmation.
3.1 Customers may request a quotation and book Services by telephone or through any other booking channel made available by Waste Disposal Stockwell from time to time.
3.2 When requesting a quotation, the Customer must provide accurate information about the type, quantity and location of Waste, as well as access conditions and any potential restrictions, such as limited parking, height restrictions, or time-limited access.
3.3 Quotations are based on the information provided by the Customer. If, on arrival, the Waste to be collected is materially different in type or volume, or access is more difficult than described, Waste Disposal Stockwell reserves the right to revise the quotation, apply additional charges, or decline to carry out part or all of the Services.
3.4 A booking is not confirmed until the Customer has accepted the quotation and Waste Disposal Stockwell has issued a booking confirmation, which may be provided verbally, by email, or by text message, depending on the booking method used.
3.5 By confirming a booking, the Customer warrants that they have the authority to enter into the Agreement and that they are the owner of the Waste or have the owner’s authority to arrange its collection and disposal.
4.1 Waste Disposal Stockwell provides Services primarily within Stockwell and surrounding areas, as determined by the company from time to time. Acceptance of a booking request is subject to service area coverage and availability.
4.2 The Customer is responsible for ensuring safe and reasonable access to the collection location, including any necessary permissions for parking, entry into private land, or access to communal areas.
4.3 If access is obstructed or unsafe, Waste Disposal Stockwell may, at its discretion, refuse to carry out the Service, rearrange the booking, or charge a waiting or wasted journey fee to cover costs incurred.
5.1 The Customer must ensure that:
(a) the Waste is presented in a manner that is reasonably safe for collection personnel to handle, including secure packaging of loose items where feasible;
(b) any hazardous or restricted items are disclosed in advance and separated as required;
(c) access to the premises is provided at the agreed time and any entry codes, contact details or instructions are accurate and up to date;
(d) all pets, children and uninvolved persons are kept away from the work area during collection.
5.2 The Customer must not present for collection any Waste that is prohibited under applicable law or under these Terms and Conditions, including but not limited to certain types of clinical, chemical, or hazardous materials, unless expressly agreed in writing beforehand.
6.1 Waste Disposal Stockwell operates in compliance with relevant UK waste management legislation and regulatory requirements. All Waste collected is transported and disposed of only at authorised facilities and in accordance with applicable duty of care obligations.
6.2 The Customer must clearly identify any Waste that may be hazardous, electrical, or otherwise subject to specific handling rules, for example:
(a) electrical and electronic equipment;
(b) batteries and fluorescent tubes;
(c) paints, solvents, oils or chemicals;
(d) gas bottles and pressurised containers;
(e) asbestos or suspected asbestos-containing materials.
6.3 Waste Disposal Stockwell reserves the right to refuse collection of any item which, in its reasonable opinion, could pose a risk to health, safety, the environment, or compliance with waste regulations.
6.4 Title to the Waste transfers to Waste Disposal Stockwell upon collection, except for any items which are prohibited or refused, which remain the responsibility of the Customer.
7.1 Prices are typically based on the volume and type of Waste collected, the labour required, access conditions, and any specific disposal costs. Where possible, an estimated price will be provided before collection, subject to confirmation on site.
7.2 All prices quoted are exclusive of any applicable VAT, which will be charged at the prevailing rate if applicable, unless expressly stated as inclusive.
7.3 Payment is due in full on completion of the Services, unless alternative payment terms have been agreed in advance. Waste Disposal Stockwell may require a deposit or full prepayment at the time of booking for certain services or larger collections.
7.4 Accepted payment methods may include cash, debit or credit card, bank transfer, or other methods notified by Waste Disposal Stockwell. The Customer is responsible for ensuring that funds are available and that payment details are accurate.
7.5 In the event of late payment, Waste Disposal Stockwell reserves the right to charge interest on overdue sums at the statutory rate and to recover any reasonable costs incurred in pursuing payment.
8.1 The Customer may cancel or amend a booking by giving reasonable notice to Waste Disposal Stockwell. Where possible, cancellations or changes should be made at least 24 hours before the scheduled collection time.
8.2 If the Customer cancels less than 24 hours before the scheduled collection, Waste Disposal Stockwell may charge a cancellation fee to cover administrative and scheduling costs.
8.3 If the Customer is not present or cannot be contacted at the agreed time, or access cannot be gained due to circumstances within the Customer’s control, Waste Disposal Stockwell may treat this as a late cancellation and charge a call-out or wasted journey fee.
8.4 Waste Disposal Stockwell may cancel or reschedule a booking due to circumstances beyond its reasonable control, including extreme weather, traffic conditions, vehicle breakdown, staff illness, or compliance and safety concerns. In such cases, the Customer will be offered a new appointment time. Waste Disposal Stockwell will not be liable for any loss arising from such rescheduling or cancellation, other than a refund of any prepayments for Services not provided.
9.1 While Waste Disposal Stockwell aims to provide Services at the agreed time and date, any times stated for arrival or completion are estimates only and are not guaranteed.
9.2 The Customer acknowledges that traffic, parking, access issues and other unforeseen events may cause delays. Waste Disposal Stockwell will use reasonable efforts to keep the Customer informed of significant delays and to rearrange appointments where necessary.
10.1 Waste Disposal Stockwell will exercise reasonable care and skill in providing the Services. However, except as set out in this Agreement, all warranties, representations and conditions implied by statute or common law are excluded to the fullest extent permitted by law.
10.2 Nothing in these Terms and Conditions limits or excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be limited or excluded.
10.3 Subject to the preceding clause, Waste Disposal Stockwell will not be liable for:
(a) any loss of profits, loss of business, loss of revenue, or loss of anticipated savings;
(b) any indirect or consequential loss or damage;
(c) any loss or damage arising from inaccurate information supplied by the Customer, including misdescribed Waste or access conditions;
(d) any damage to items which the Customer has asked to be removed and which are, or may be, of sentimental, special, or disproportionate value where such value has not been clearly stated in advance.
10.4 If, notwithstanding the above, Waste Disposal Stockwell is found liable for any loss or damage arising out of or in connection with the Services, its total aggregate liability to the Customer shall be limited to the total price paid or payable for the specific Services giving rise to the claim.
10.5 The Customer is responsible for securing or removing any items they wish to retain before the collection begins. Waste Disposal Stockwell accepts no responsibility for items taken in error if they were not clearly identified as items to be retained.
11.1 Waste Disposal Stockwell will take reasonable care to avoid damage when collecting Waste. The Customer must inform the collection team of any fragile surfaces, hidden cables, pipes, or other vulnerable features.
11.2 Waste Disposal Stockwell shall not be liable for normal wear and tear or superficial damage to flooring, paintwork, or fixtures arising from the reasonable performance of the Services, particularly in tight or restricted spaces where large items are being removed.
11.3 Any claim for damage to property must be notified to Waste Disposal Stockwell as soon as reasonably practicable and in any event within 7 days of the Service, providing sufficient details and supporting evidence to allow investigation.
12.1 The Customer agrees to behave courteously towards collection staff and not to engage in any abusive, threatening, or otherwise inappropriate behaviour.
12.2 Waste Disposal Stockwell reserves the right to withdraw Services immediately if staff are subjected to unsafe conditions, harassment, or aggression, and to charge for any costs incurred up to that point.
12.3 The Customer must comply with any reasonable health and safety instructions given by Waste Disposal Stockwell staff during collection activities.
13.1 Waste Disposal Stockwell will collect and process personal data such as names, contact details, addresses, and payment information solely for the purpose of providing Services, managing bookings, processing payments, and handling queries or complaints.
13.2 Personal data will be handled in accordance with applicable UK data protection laws. Information may be retained for legal, accounting, or operational reasons for a reasonable period, after which it will be securely deleted or anonymised.
14.1 If the Customer is dissatisfied with any aspect of the Services, they should contact Waste Disposal Stockwell as soon as possible to allow the matter to be investigated and, where appropriate, remedied.
14.2 Waste Disposal Stockwell aims to respond to complaints promptly and to resolve them fairly. The Customer agrees to provide all relevant information and reasonable cooperation during the investigation.
15.1 Waste Disposal Stockwell may amend these Terms and Conditions from time to time to reflect changes in law, best practice, or business operations. The current version will apply to all new bookings at the time of confirmation.
15.2 Any variation to these Terms and Conditions requested by the Customer will only be valid if expressly agreed in writing by an authorised representative of Waste Disposal Stockwell.
16.1 If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable by a court or other competent authority, that provision shall be deemed deleted, but such deletion shall not affect the validity and enforceability of the remaining provisions.
17.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them, their subject matter or formation, shall be governed by and construed in accordance with the laws of England and Wales.
17.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of the Services.
By confirming a booking with Waste Disposal Stockwell, the Customer acknowledges that they have read, understood, and agree to be bound by these Terms and Conditions.
